Terms and Conditions

ATTENTION: USING MY TECH SQUAD SERVICES OR THIS WEBSITE INDICATES THAT YOU HAVE READ AND ACCEPT THESE TERMS AND CONDITIONS, AND ANY SUBSEQUENT AMENDMENTS. IF YOU DO NOT ACCEPT THESE TERMS, DO NOT USE MY TECH SQUAD SERVICES OR THIS WEBSITE.

TERMS AND CONDITIONS

THESE TERMS AND CONDITIONS (“TERMS”) SET FORTH IMPORTANT REQUIREMENTS REGARDING YOUR USE OF THE MY TECH SQUAD WEBSITE, MY TECH SQUAD SUPPORT SERVICE, AND YOUR RELATIONSHIP WITH MY TECH SQUAD. WE ADVISE YOU TO READ THEM CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION AND INSTRUCTIONS, SUCH AS HOW LONG THESE TERMS LASTS, FEES FOR EARLY TERMINATION, OUR RIGHTS TO CHANGE THE CONDITIONS, LIMITATIONS OF LIABILITY, PRIVACY POLICY, AND SETTLEMENT OF DISPUTES BY ARBITRATION INSTEAD OF IN COURT. THIS AGREEMENT SHALL APPLY TO ANY AND ALL SERVICE PLANS PROVIDED BY  MY TECH SQUAD, INCLUDING EXISTING PLANS. ACCEPTANCE OF THESE TERMS SHALL BE IMPLIED BY THE USE OF  MY TECH SQUAD  SERVICES OR THE MY TECH SQUAD WEBSITE.

ENTIRE AGREEMENT

These Terms, together with the accepted Service Plan Order, Privacy Policy, Refund Policy, and Fair Use Policy, constitute the entire agreement between you and MY TECH SQUAD (“Agreement”). Acceptance of this Agreement is a condition to the use of the MY TECH SQUAD Services and website.

The MY TECH SQUAD Privacy Policy (http://www.mytechsquad.com.au/) and Refund Policy (http://www.mytechsquad.com.au/refund-policy/) are an integral part of this Agreement. Accordingly, the Privacy Policy and Refund Policy are fully incorporated into these Terms.

Please review the Privacy Policy and Refund Policy prior to agreeing to these Terms. You agree that beyond the personal information identified in the Privacy Policy, any information or data disclosed, transmitted, submitted, or sent to MY TECH SQUAD by telephone, electronically, online, or other means is not confidential, protected, or proprietary to you. Upon submission, you relinquish all rights to such information. Subsequently, all disclosed information becomes the property of MY TECH SQUAD.

These Terms govern all plans available through the MY TECH SQUAD Website, and any use of the MY TECH SQUAD Portal. In the event of any conflict, these Terms control any submitted Plan Order Requesting Services (“Plan Order”).

KEY TERMS

” MY TECH SQUAD “

“MY TECH SQUAD” is a trademark under an authorization from MY TECH SQUAD . All references to MY TECH SQUAD refer to MY TECH SQUAD.

“MY TECH SQUAD CERTIFIED TECHNICIAN”

“MY TECH SQUAD Certified Technician” means the technicians and specialists certified by MY TECH SQUAD to perform the Services in accordance with this Agreement and accepted Plan Order.

“MATERIALS”

“Materials” means any webcasts, download areas, white papers, press releases, articles, posted information, datasheets, Frequently Asked Questions(“FAQs”), product information, quick reference guides, and any other information available to download from the MY TECH SQUAD Portal. All Materials are the proprietary and copyrighted work of MY TECH SQUAD and its suppliers.

“SOFTWARE”

“Software” means any computer program, whether owned or operated by MY TECH SQUAD or a third-party, delivered by download, compact disk, other media forms, or any other transmission method. Software elements and contents are protected by intellectual property law, including copyright, trade secret, unfair competition, and any other applicable law. Use of the Software is subject to the accompanying agreements, such as a License Agreement or User Agreement, which is included with the Software, ordering documents, exhibits, or any other terms and conditions that may apply (“License Terms”).

“SERVICE”

“Service” means any MY TECH SQUAD service provided by MY TECH SQUAD Technical Services Private Limited, under the submitted and accepted plan order. You may order a plan via the MY TECH SQUAD Portal or by calling 1-800-767-821

EXCLUSIONS FROM “SERVICE”

“Service” shall not include the following:

  • (1) items or activities not provided in an accepted Plan Order;
  • (2) service outside the specified period of time in an accepted Plan Order;
  • (3) incomplete problem diagnose or support resulting from a conflict with a Subscriber’s computer, hardware, or configuration;
  • (4) software not provided in an accepted Service Plan, including the operating system, software previously installed, and software installed without MY TECH SQUAD’s advisement;
  • (5) problems resulting from:
    • (a) external causes, such as an accident, abuse, misuse, or electrical problems;
    • (b) use violating a product manufacture’s terms and conditions;
    • (c) any violation of a product manufacture’s License Terms;
    • (d) failure to perform preventive maintenance;
    • (e) use of an accessory, hardware part, or component incompatible with MY TECH SQUAD’s Service or provided product; or
    • (f) non-compliance with or failure to follow the MY TECH SQUAD Technician’s instructions providing the Service.

“SUBSCRIPTION BASED PLAN”

“Subscription Based Plan” or “Subscription” means the tenured Subscription plan offered by MY TECH SQUAD that is active for defined period of time and does not include any incident based plans, such as “Per Incident Plan.”

“YOU” AND “USER”

“You” and “User” means any individual person or entity, including an employer that an individual represents to act on behalf of or MY TECH SQUAD believes the individual represents.

“SUBSCRIBER”

“Subscriber” and User that is provided Services in accordance with an accepted Plan Order.

NOTICE SPECIFIC TO MATERIALS AND SOFTWARE AVAILABLE ON THE MY TECH SQUAD PORTAL OR SERVICE

For your convenience, MY TECH SQUAD may provide Materials and Software in performing Services or in promotion of the Services. Use of such Materials and Software is governed by the terms and conditions of the provided End User License Agreement (“License Agreement”). If there is no accompanying License Agreement, these Terms and Agreement contained herein shall govern the use of the Materials and Software.

The Materials and Software are provided solely for your individual use and is subject to the License Agreement, the Plan Order, and this Agreement.

Any unpermitted reproduction, duplication, or redistribution of the provided Service not in accordance with the License Agreement, Plan Order, and this Agreement is expressly prohibited; violation of such agreements may result in severe civil and criminal penalties. A violating User shall be held fully liable and responsible to the furthest extent of the law.

No logo, graphic, sound, or image from the MY TECH SQUAD website may be copied or retransmitted, unless MY TECH SQUAD provides express written consent.

WITHOUT LIMITING THE FOREGOING, DOWNLOADING, COPYING, OR REPRODUCTION OF THE MATERIALS OR SOFTWARE TO AN EXTERNAL SERVER OR LOCATION FOR THE PURPOSE OF FURTHER REPRODUCTION, DUPLICATION, MODIFICATION, REVERSE ENGINEERING, REDISTRIBUTION, OR ANY OTHER UNPERMITTED USE IS EXPRESSLY PROHIBITED, UNLESS SUCH OTHERWISE EXPRESSLY PERMITTED BY THE ACCOMPANYING LICENSE AGREEMENT.

SUBMISSION OF PLAN ORDERS; SERVICE PLANS

You may order an MY TECH SQUAD Service by submitting a Plan Order via the MY TECH SQUAD Portal or by calling 1-800-767-821. After MY TECH SQUAD accepts the submitted Order, you will receive an email confirming the accepted Service Plan (“Service Plan”). MY TECH SQUAD is not responsible for performing a Service not specified or detailed in an accepted Plan Order. Furthermore, MY TECH SQUAD shall not have any obligation or duty to a Plan Order that is not accepted.

UNDERTAKING

In accordance with these Terms and Service Plan, MY TECH SQUAD will perform the agreed to Services resolving the Subscriber’s issues using commercially reasonable efforts.

In most cases, MY TECH SQUAD will attempt a problem diagnosis and solution by an online chat, email, telephone, remote access, or other means to resolve the issue.

If Service is performed by remote access, no residual software will remain on the Subscriber’s computer once the remote session is ended. There may, however, be a text file stored on the remotely accessed computer describing the Services performed by MY TECH SQUAD; this file may be deleted or saved for the Subscriber’s future reference.

Each Service Plan is subject to the MY TECH SQUAD Limited Warranty set forth below.

PAYMENT

All payments must be made in accordance with the Plan Order and these Terms. Additionally, MY TECH SQUAD reserves the right to refuse any form or method of payment. Once payment is accepted, MY TECH SQUAD will make it Services available to the Subscriber. No Service shall be performed if payment violates the Plan Order, these Terms, or is not accepted by MY TECH SQUAD.

Fees. In consideration for MY TECH SQUAD providing its Services, You agree to pay MY TECH SQUAD all applicable Activation Fees and Service Fees. In its discretion, MY TECH SQUAD may increase such fees at any time and without notice. Fees shall be paid at the commencement of the Service Plan.

Activation Fee. Most plans require payment of a non-refundable fee at the time of registration as specified in the Plan Order (“Activation Fee”).

6 Month Payment Plan. The 6 Month Payment Plan is a six-month Service agreement (“Subscription Period”) with a one-time, up-front payment prior to the performance of services. This Plan Order expires at the end of the Subscription Period and does not automatically renew.

Bundle Discount. Plan Orders may offer a discount if you agree to additional MY TECH SQUAD services (“Bundle Discount”). The Bundle Discount offer is conditioned on you continuing all Services you agreed to in the Plan Order for the Subscription Period.

The price of the Plan remains effective until (i) the Term Plan expires, (ii) you drop a Service you agreed to in the Bundle Discount, or (iii) you terminate the Service Plan or this Agreement before the expiration of the term.

Valid Payment Method. You shall provide and maintain a valid credit card or debit card accepted by and on file with MY TECH SQUAD to purchase a Service; you must keep a valid credit or debit card on file in the until the Subscription Plan or this Agreement is terminated.

Payment by credit card or debit card shall also be subject to the terms and conditions provided by the card issuer.

Remaining Balance. MY TECH SQUAD may charge and place a hold on your credit or debit card for any remaining unpaid balance. You authorize the card issuer to pay amounts owed to MY TECH SQUAD, and without requiring a signed receipt. You authorize MY TECH SQUAD, applicable third-parties, and any billing agent for MY TECH SQUAD to continue to charge and place a hold on your card for the entire balance owed until the amount owed is paid in full. In the attempt to charge and place a hold on the card you provided, MY TECH SQUAD shall not be liable for any costs or fees you incurred for insufficient funds.

By enrolling in an automatic payment or electronic funds transfer plan, MY TECH SQUAD may charge all costs to the provided account number.

Insufficient Funds Fee. You will be charged an additional $15.00 fee if charges cannot be processed because of insufficient funds.

Refund of Fees. If the Service Plan is cancelled, paid fees shall not be refunded unless otherwise expressly permitted by the Plan Order.

REFUND POLICY

Subscription Based Plans. For Subscription Based Plans, a full refund of the price for the Plan will be issued if MY TECH SQUAD is unable to resolve each issue specified in the Plan Order within the first 30 days of the Subscription Period (“30 Day Guarantee”).

However, the fees for the Subscription Service will not be refunded if a specified issue is resolved. In its sole discretion and on an individual basis, MY TECH SQUAD may nevertheless agree to a refund the Subscription fees after deducting costs for providing the Service.

Incident Based Plans. For Incident Based Plans, you are eligible for a refund if (i) the issue was not resolved within 30 days of the Technician starting the Service, and (ii) you have not violated the Plan Order or this Agreement.

PRIVACY POLICY: PERSONAL AND NONCOMMERCIAL USE LIMITATION

Unless provided otherwise, the Services, Materials, and Software are available solely for your individual, personal and non-commercial use in resolving the issues specified in the Service Plan. You may not modify, copy, duplicate, reproduce, distribute, transfer, transmit, display, perform, publish, license, reverse engineer, create derivative works from, nor sell any information, software, product, or service obtained from the Services, Materials, or Software. All Services, Materials, and Software are available for the sole purpose to assist in resolving the issues specified in the accepted Service Plan.

NO UNLAWFUL OR PROHIBITED USE

As a condition to the use of the MY TECH SQUAD Portal and Services, you shall not use the Services, Materials, or Software for any purpose or in any manner that is unlawful or prohibited by these Terms. You shall not use the Services, Materials, or Software in any manner that may result in damaging, disabling, overburdening, or impairing any MY TECH SQUAD server or connected network, or interfere with a third-party’s use and enjoyment of the MY TECH SQUAD Portal, Materials, Software, or Services. Any attempt to gain unauthorized access to the MY TECH SQUAD Portal, Materials, Software, Services, other accounts, computer systems or networks connected to any MY TECH SQUAD server or to any of the MY TECH SQUAD Portal, by hacking, password mining, or any other intrusive means is expressly prohibited. You shall not obtain, or attempt to obtain, any part of the MY TECH SQUAD Portal, Materials, Software, Services, or information by any means not explicitly permitted in the Plan Order.

FAIR USAGE POLICY

Each Subscriber’s use of MY TECH SQUAD’s support Services are subject to the MY TECH SQUAD “Fair Use Policy.” The “Fair Use Policy” prohibits a Subscription Based Plan customer from abusing the Service by exceeding the standard level of use reasonably expected by another Subscriber. Although there are no limitations on the amount of requests for online support under a Subscription Based Plan, MY TECH SQUAD reserves the right to suspend or terminate the Subscriber’s Subscription Service if the User is believed to be violating the Fair Use Policy.

SUSPENSION OF SUBSCRIPTION

MY TECH SQUAD may suspend or terminate any Subscription Services of any Subscriber that it determines are being used either (i) fraudulently, (ii) by any person other than the Subscriber, or (iii) for any computer system other than a registered system.

TERMINATION OF SUBSCRIPTION

A Subscriber may terminate the Service Plan at any time by giving written or electronic notice to MY TECH SQUAD; provided, however, the Subscriber shall not be receive a refund of fees already paid.

COMMUNICATIONS SERVICES

MY TECH SQUAD may provide the use of e-mail services, addresses, bulletin board services, instant messaging services, chat areas, news groups, forums, communities, personal web pages, calendars, file cabinets, or other communication facilities designed to enable the User to communicate with MY TECH SQUAD employees and third-parties as appropriate to the Service provided in a Plan Order (“Communication Service”). The Communication Service shall only be used under an accepted Plan Order and not for any other purpose.

USE OF COMMUNICATION SERVICES

You shall only use the Communication Service to post, send, and receive messages and materials in accordance with these Terms and the Plan Order. In addition to the other unpermitted uses specified in the Plan Order and these Terms, you shall not use the Communication Service:

  • 1) in connection with surveys, contests, pyramid schemes, chain letters, junk email, spamming, or any duplicative or unsolicited messages, including commercial and non-commercial use;
  • 2) to defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of any other, including the right of privacy and publicity;
  • 3) to publish, post, upload, distribute, or disseminate any inappropriate, profane, defamatory, obscene, indecent, or prohibited topic, name, material, or information;
  • 4) to upload or make available any file containing an image, photograph, service, or other material that you do not own, have the right to, or have not received the necessary consent and is protected by intellectual property laws, including copyright law, trademark law, and the right to privacy;
  • 5) to use any material or information contained in the Materials, including images and photographs, that violates a copyright, trademark, patent, trade secret, or other proprietary right of any party.
  • 6) to upload a file containing a virus, trojan horse, worm, time bomb, cancel bot, corrupted file, or other similar service or program that may damage the operation of another’s computer or property;
  • 7) to advertise, offer to sell, or offer to buy any goods or services for any commercial purpose, unless permitted by the Communication Service;
  • 8) to download a file posted or uploaded by another Subscriber of the Communication Service that you know, or reasonably should know, cannot be legally reproduced, displayed, performed, or distributed in such a manner;
  • 9) to falsify or delete any notice of proprietary rights, including author attributions, legal or other lawful notices, proprietary designations, labels of the origin or source of service, or other material contained in a file that is uploaded;
  • 10) to restrict or inhibit another Subscriber from using the Communication Service;
  • 11) to violate a code of conduct or guidelines applicable to the Communication Service;
  • 12) to harvest or otherwise collect information regarding other Subscribers, including names and email addresses;
  • 13) to violate any applicable law or regulation;
  • 14) to create a false identity for the purpose of misleading MY TECH SQUAD or a third-party;
  • 15) to download, copy, or otherwise provide a third-party with a directory or list of the Materials, Subscribers, or any usage information, whether for commercial or noncommercial purposes.

MY TECH SQUAD may monitor the Communication Service at any time and without notice. MY TECH SQUAD may, in its sole discretion, review and remove any material or information posted or uploaded to the Communication Service. MY TECH SQUAD may terminate a Subscriber’s access to the Communication Service at any time, for any reason whatsoever, and without notice.

MY TECH SQUAD may disclose information it deems necessary to satisfy applicable laws, regulations, legal processes, or governmental requests. MY TECH SQUAD may edit, refuse to make available, or remove any information or materials contained in the Communication Service.

Any material or information uploaded to the Communication Services shall be subject to the respective limitations on usage, reproduction, and dissemination. You shall download material or information in accordance with such applicable limitations.

LINKING

You shall not create a hyperlink to the MY TECH SQUAD Portal, or any Material or Software contained therein.

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless MY TECH SQUAD and all MY TECH SQUAD Technicians, subsidiaries, affiliates, officers, directors, employees, agents, licensors, consultants, suppliers, and any third-party provider, from and against all causes of action, suits, claims, demands, liabilities, losses, damages, costs, and expenses, including attorney’s fees, caused by your use or another’s use, whether or not you permitted access, of the Service, Software, or Material resulting in:

  • (i) a violation of applicable law, regulation, governmental request, Plan Order, or this Agreement;
  • (ii) the misuse or abuse of the Service;
  • (iii) a negligent act, error, or omission;
  • (iv) an injury to or death of another;
  • (v) any damage to or loss of property, limited only by the liability of a third-party’s negligence or willful misconduct; or
  • (vi) a claim for infringement of intellectual property.

In such an event, you shall cooperate as reasonably required in MY TECH SQUAD’s defense. You shall not settle any matter without MY TECH SQUAD’s express written consent. MY TECH SQUAD may assume the exclusive defense and control of any matter, action, claim or litigation at its own expense, which would otherwise be subject to your indemnification

You shall immediately notify MY TECH SQUAD of any known unauthorized use of your account or breach of security, or of such unauthorized use or breach that you reasonably should have known.

GUESTS

“Guest” means any individual that does not have an accepted Service Plan Order. An existing Subscriber is considered a Guest for any use of the MY TECH SQUAD Portal not in accordance with the Plan Order or these Terms.

LIMITED LICENSE TO GUEST

A Guest may use the MY TECH SQUAD Portal and Materials specifically made available to Guests for the limited purpose in deciding whether to subscribe to a Service Plan, registering with MY TECH SQUAD, or submitting a Plan Order.

MY TECH SQUAD may revoke, terminate, or limit a Guest’s use of the MY TECH SQUAD Portal and Materials at any time and without notice.

LIMITED LICENSE OF USE

You shall use the MY TECH SQUAD Portal, Services, Materials, and Software in accordance with the respective Plan Order and these Terms. MY TECH SQUAD may terminate any use or access it believes is in violation of the Plan Order or this Agreement.

GENERAL LICENSE RESTRICTIONS

Use of the MY TECH SQUAD Portal, Services, Materials, and Software shall be in accordance with the Plan Order and these Terms; any other use is expressly prohibited.

MY TECH SQUAD and suppliers shall have the right to execute, copy, modify, display, transmit, distribute, manufacture, use, and sale the MY TECH SQUAD Portal, Services, Materials, and Software. You shall not execute, copy, modify, display, transmit, distribute, manufacture, use, or sale of the aforementioned. Likewise, you shall not reverse engineer or recompile any part of the Software or Portal.

USER RESPONSIBILITY

You shall comply with the Technician’s directions in accordance with these Terms and the Service Plan. In our experience, most issues are resolved by the unhindered cooperation between the Subscriber and Technician. Please listen carefully to and follow the instructions of the Technician during the Service.

Service is subject to the following conditions:

  • (1) Reproducible. The condition or environment producing the issue is reproducible on a single system, i.e., one central processing unit with its workstations and peripherals;
  • (2) Knowledge. You have knowledge of the hardware system, applicable software, and facts or circumstances related to the environment producing the issue;
  • (3) Access. The full computer system, including all software and hardware, is available to you and may be accessible by you without limit during communications with MY TECH SQUAD, Technician, and any support personnel.
  • (4) Software and Data Backup. MY TECH SQUAD advises you to maintain a backup of your software and data. MY TECH SQUAD strongly recommends that you have a complete data backup and disaster recovery plan. Accordingly, MY TECH SQUAD shall not be responsible for any lost, damaged, or corrupted software and data.
  • (5) Account, Password, and Security. To submit a Plan Order, you must complete the registration process by providing valid, current, complete, and accurate information as prompted and required by the applicable registration form (“Registration Process”). During registration you will create a username and password. You shall be solely and exclusively responsible for maintaining the confidentiality of your username and password; you shall be solely and exclusively responsible for any use of your account. You shall notify MY TECH SQUAD immediately of any known, or reasonably should have known, unauthorized use or breach of security. MY TECH SQUAD shall not be liable for any damages resulting from another’s use of your account or password, whether or not you have knowledge of such use. Nevertheless, you may be liable for the unauthorized use of your account resulting in a claim, loss, or damage to MY TECH SQUAD or a third-party. You shall not use any other Subscriber’s account, unless otherwise explicitly permitted by the Subscriber.

FORCE MAJUERE

MY TECH SQUAD shall not be liable for delays, damages, or failures to perform a Service resulting from a circumstance beyond its control, including acts of a government, God, third-party, riot, war or other military action, civil disorder, terrorism, vandalism, fire, flood, strike or other labor-related dispute, or because of an inability to obtain necessary equipment or services. If any damage results from such events, MY TECH SQUAD shall not be liable for any damages caused by such delays, damages, or the failure to provide a Service.

MY TECH SQUAD or third-party providers may restrict the use, time of availability, or maintain session control of the Service and the registered computer system at any time, without notice or liability.

END USER LICENSE AGREEMENTS: “LICENSE AGREEMENT”-GENERALLY

In providing a Service, MY TECH SQUAD may allow the use of Software owned by MY TECH SQUAD and a third-party licensor or supplier. Provided Software may include a License Agreement. Use of the Software shall be in accordance with the License Agreement, Service Plan, and these Terms. Before use may begin, you must complete the specific requirements to install, update, or upgrade the Software. You impliedly agree to the License Agreement and these Terms by using the Software. After installing, MY TECH SQUAD and the third-party licensor may update or change the Software at any time.

LICENSE AGREEMENT FOR MY TECH SQUAD SOFTWARE

“MY TECH SQUAD Software” means the Software available via the MY TECH SQUAD Portal that does not require the acceptance of a separate License Agreement. MY TECH SQUAD Software is the confidential and proprietary property of MY TECH SQUAD and third-party licensors, providers, or suppliers

You may use the MY TECH SQUAD Software and any Software corrections, updates, or upgrades. This permitted use is a revocable, non-exclusive, and non-transferable license from MY TECH SQUAD. Your use of the MY TECH SQUAD Software shall be in accordance with the License Agreement, Service Plan, and these Terms.

Unless otherwise permitted by the Service Plan, you shall not (i) copy or export the MY TECH SQUAD Software, (ii) use or disclose the MY TECH SQUAD Software to a third-party, (iii) decompile, reverse technician, disassemble, or attempt to discover any source code, underlying ideas, and algorithms of the MY TECH SQUAD Software, (iv) otherwise reduce the MY TECH SQUAD Software to a human readable form, (v) modify, rent, lease, loan, use for timesharing or service bureau purposes, reproduce, sublicense, distribute copies of the Software, or otherwise transfer the MY TECH SQUAD Software to any third-party, (vi) remove or modify any trademark, tradename, copyright, or other proprietary notices, legends, symbols, and labels contained in the MY TECH SQUAD Software, or (vii) use the MY TECH SQUAD Software outside the country you resided when you accepted these Terms and Service Plan.

MY TECH SQUAD and the third-party licensors, providers, and suppliers shall retain all the rights, title, and interest to the MY TECH SQUAD Software and related Materials, updates, or changes, including all copyrights, patents, trademarks, trade secrets, and moral rights. License to the MY TECH SQUAD Software shall remain in full force and effect until (i) terminated by MY TECH SQUAD or a third-party licensor, provider, or supplier, or (ii) the Service Plan is terminated as provided in the Plan Order or these Terms. Upon termination of the Service Plan, you shall cease all use of the Service Plan and MY TECH SQUAD Software; you shall immediately delete the MY TECH SQUAD Software from your registered computer.

THIRD PARTY PRODUCTS

In providing a Service, MY TECH SQUAD may recommend that you acquire, install, and use a third-party’s software or service (“Third Party Software”). Third-party services include technical support, portal, website, training, music, gaming, or digital storage. MY TECH SQUAD may make available such third-party services at any time and on a case-by-case basis.

The Third Party Software’s owner and licensee grant you a revocable, non-exclusive, and non-transferable license to use the Software. MY TECH SQUAD does not license, take responsibility, or have a right to the Third Party Software. Furthermore, MY TECH SQUAD makes no representation or warranty in the Third Party Software, or is MY TECH SQUAD an authorized service provider for Third Party Software or equipment. You shall only have a cause of action or claim against the third-party provider. Such third-party provider is solely responsible for delivery and your use of its services.

Before installing, you shall agree to the Terms set forth by such third-party owners and licensees. Such agreement is a prerequisite condition even if MY TECH SQUAD assists you in the acquisition, installation, and use of the Third Party Software. You shall ensure compliance with the applicable Terms licensed by the respective Third Party Software.

Your use of Third Party Software shall be in accordance with the Terms from such third-party service or software provider. MY TECH SQUAD may terminate your account, Service Plan, and Use of the Service if you are believed to be in violation of such third-party provider’s Terms of service.

Importantly, support of Third Party Software or equipment by an unauthorized service provider may void any warranty made by the Third Party Software or equipment provider. Therefore, it is your sole responsibility to determine and acquire additional rights and permissions as required for MY TECH SQUAD to provide such support.

LIMITED SERVICE WARRANTY

TO THE EXTENT PERMITTED BY LAW, MY TECH SQUAD DISCLAIMS ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS AND SERVICE PLAN, MY TECH SQUAD AND THE RESPECTIVE THIRD PARTY PROVIDERS MAKE NO SPECIFIC PROMISES OR REPRESENTATIONS ABOUT THE PROVIDED SERVICES, MATERIALS, OR SOFTWARE. MOREOVER, WE DO NOT MAKE ANY COMMITMENTS ABOUT THE CONTENT OR INFORMATION CONTAINED IN THE MATERIALS, SERVICES, AND SOFTWARE, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS. WE PROVIDE THE SERVICES AND MATERIALS “AS IS,” WITHOUT WARRANTY OR REPRESENTATION OF ANY KIND WHATSOEVER. YOUR SOLE REMEDY IS TO EITHER (1) ALLOW MY TECH SQUAD TO RE-PERFORM THE SERVICES SUBJECT TO DISPUTE, OR (B) RE-DOWNLOAD AND REINSTALL THE APPLICABLE SOFTWARE.

THE 7-DAY LIMITED SERVICE WARRANTY PROVIDED IN SOME SERVICE PLANS IS SUBJECT TO THE REQUIREMENTS AND CONDITIONS SPECIFIED IN THE SERVICE PLAN AND THESE TERMS.

PROVIDED MATERIALS MAY INCLUDE TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS. MY TECH SQUAD AND THIRD-PARTY PROVIDERS MAY ADD, CHANGE, IMPROVE, OR UPDATE THE MATERIALS AND SOFTWARE, AND CONTENT OR INFORMATION CONTAINED THEREIN, AT ANYTIME AND WITHOUT NOTICE.

LIMITATION OF LIABILITY

WHEN PERMITTED BY LAW, MY TECH SQUAD AND THIRD-PARTY PROVIDERS, WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, DATA, OR USE, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

THIS LIMITATION INCLUDE DAMAGES INCURRED BY YOU OR THIRD-PARTY, WHETHER ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF SERVICES, MATERIALS, SOFTWARE, FAILURE TO PROVIDE THE SAME, OR INFORMATION CONTAINED THEREIN.

TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF MY TECH SQUAD AND THIRD-PARTY PROVIDERS IS LIMITED TO THE AMOUNT YOU PAID FOR MY TECH SQUAD SERVICES UNDER THE DISPUTED PLAN ORDER.

IN ALL CASES, MY TECH SQUAD AND THIRD-PARTY PROVIDERS WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.

TERM AND TERMINATION
MY TECH SQUAD, in its sole election, may terminate or suspend your Service immediately, at any time and without notice if:

  • (a) you violate these Terms;
  • (b) your use is prohibited by law or is disruptive to, adversely impacts, or causes a malfunction to the Service, MY TECH SQUAD network, or the use and enjoyment of other MY TECH SQUAD Subscribers;
  • (c) MY TECH SQUAD receives a court order to terminate the Service;
  • (d) MY TECH SQUAD discontinues offering the Service for any reason;
  • (e) you cease to be an MY TECH SQUAD Subscriber, such as if an existing Subscriber considered a Guest; or
  • (f) MY TECH SQUAD determines that you are abusing the Service.

MY TECH SQUAD may refuse to accept your request for the Service following your termination or suspension to the Service.

SEVERABILITY; WAIVER

If any provision of these Terms is determined to be held invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby; the unenforceable portion shall be construed as nearly as possible to reflect MY TECH SQUAD’s original intention.

MY TECH SQUAD’s failure at any time to insist upon strict compliance with any of the provisions of these Terms shall not be construed to be a future waiver of such terms.

NO OFFER

The MY TECH SQUAD Portal may contain references to MY TECH SQUAD products, Services, or programs available outside a Subscriber’s country; any such reference does not imply an offer to the unavailable products, Services, or programs within such Subscriber’s country.

MODIFICATIONS/REVISIONS

MY TECH SQUAD may make changes to these Terms, MY TECH SQUAD Portal, Services, Materials, and Software or products at any time and without notice.

Furthermore, you and MY TECH SQUAD agree to submit to the exclusive jurisdiction of the courts in Texas over any dispute, claim, or cause of action arising out of this Agreement. MY TECH SQUAD reserves the right to determine the method in resolving the legal matter, including whether by arbitration, moderation, or use of the court.

If any provision of this Agreement is held by a court of competent jurisdiction to be contrary to law, then such provision shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.

You and MY TECH SQUAD agree that any cause of action arising out of or related to the Service must commence within one (1) year after the cause of action arises; otherwise, such cause of action is permanently barred.
